Terms of Service

These terms apply when you create an account, subscribe to, or use MyGarden Assistant. MyGarden Assistant is a gardening information service provided for home gardeners.

Subscription and billing

The subscription price is NZ$6.99 per month. Stripe processes payments, and the subscription renews each month until cancelled. You can cancel through subscription management.

If cancellation is scheduled, paid access continues until the end of the current paid period unless Stripe or applicable law requires otherwise. A cancellation stops future renewals; it does not normally create a refund for time already paid for. Any rights you have under New Zealand consumer law continue to apply.

Gardening guidance

MyGarden Assistant provides general gardening information, not a guarantee of results. Gardening responses may be incomplete, outdated, or incorrect because plants, weather, soils, products, and local conditions vary.

Plant, pest, disease, and nutrient identification from descriptions or photos is not guaranteed. Treat diagnoses as guidance and seek an appropriately qualified local professional when the consequences of a mistake could be significant.

You remain responsible for gardening, plant-care, food-safety, pesticide, fertiliser, spray, and chemical decisions. Always follow current New Zealand product labels, approved uses, application rates, safety instructions, withholding periods, and relevant laws. Do not rely on MyGarden Assistant to replace label directions or professional advice.

Your account

You are responsible for providing accurate account information, protecting your login details, and activity performed through your account. Tell NZ Veggie Plants promptly if you believe your account has been compromised.

Acceptable use

You must not misuse the service, attempt unauthorised access, evade usage or security limits, interfere with other users, upload unlawful or harmful material, probe or exploit the application, automate abusive requests, or use the service in a way that breaches applicable law or another person’s rights.

We may restrict or terminate access where reasonably necessary to address abuse, security threats, non-payment, unlawful conduct, or serious breaches of these terms.

Availability and changes

We aim to provide a reliable service, but availability is not guaranteed. Features, providers, limits, and service availability may change. We may suspend the service for maintenance, security, provider outages, or circumstances outside our reasonable control.

Liability and New Zealand consumer rights

To the extent permitted by law, NZ Veggie Plants is not responsible for indirect or consequential loss arising from reliance on gardening guidance, failed crops, plant damage, pest or disease spread, chemical use, or unavailable service. Nothing in these terms excludes, restricts, or modifies rights or remedies that cannot lawfully be excluded, including applicable rights under New Zealand consumer law.

These terms are governed by New Zealand law, and New Zealand courts have non-exclusive jurisdiction, subject to any mandatory rights you may have under applicable law.
